Agency Action Within Two Business Days of Receiving a Credible Report Constituting a Complaint:
Page 2 paragraph 6 states : An agency is encouraged to provide the Commission with a written
explanation for the amount of time that the agency takes to assess the credibility of a complaint where
the period of time exceeds a few days, and to maintain such explanation in the agency’s files, including
the officer’s personnel file.
Question: Why aren’t we defining a few days according to the dictionary.com definition ... “A few is
generally considered to mean between two and several. Some people use a few to mean around three,
but this is not a universal interpretation. Its meaning is highly relative to the context—it often depends on
what’s being discussed, especially the scale and expectations.”
Comment: | feel it best that the Chief’s of the agencies know a specific time frame or span of time that is
acceptable, unless this is intentional left broad to allow for flexibility for the Chief or agency.
Internal Resolution Policy:
“It]he head of an agency shall, within two [business] days of their receipt of a complaint” that “is related
to minor matters” and “does not involve evidence or an allegation of” certain forms of “bias,” “force,” or
“serious bodily injury or death,” ordinarily, among other things, “refer the complaint for resolution under
the agency’s internal resolution policy, which shall comply with any minimum requirements established
by the commission.”
Questions: What if we don’t have an internal resolution policy established?
Comment: Suggested corrective language “[t]he head of an agency shall, within two [business] days of
their receipt of a complaint” that “is related to minor matters” and “does not involve evidence or an
allegation of” certain forms of “bias,” “force,” or “serious bodily injury or death,” ordinarily, among other
things, “refer the complaint for resolution under the agency’s internal resolution policy, which shall
comply with any minimum requirements established by the commission or to their internal investigation
division or officer for investigation and corrective action.”
Thank you.

Dear POST Commission Portal User,
The POST Commission's LEA portal for collecting recertification applications and complaints will open
on May 22, 2023. You have been granted access to this system.
It is no longer necessary (nor possible) to fill out and upload a template for recertification data'. The
new portal has a built-in wizard that will allow you to select multiple officers from your agency, answer a
series of questions (with the same answer) and submit the application(s). If you need to upload a non-
attestation form for individual officer or answer specific questions differently per officer, you can still
use the wizard and select only the specific officer. The former system for processing recertifications (Jira)
has been retired.
When logging into the portal, you will enter your email address as the username and then type in your
password. An email will be sent to you with a passcode that will be required to complete the login
process each time you access the portal.
FAQ's and instructions can be found on the POST Commission website (Recertification Overview). If you
need help accessing the portal, please email postcsupport@mass.gov.
For questions about the recertification process and policy, please email postccertification@mass.gov.
For questions and policy about submitting complaints, please email postcreports@mass.gov.

Dear Sir/Ma‘'am:
While reviewing records in our database, it has come to our attention that the following officer(s)
employed by your department were not certified upon graduation from a full-time academy between
12/1/2021 and present date. This may be due to the following reasons:
1. The officer served in a police capacity (reserve, intermittent, SPO) on July 1, 2021, and then chose to
attend a full-time academy instead of the Bridge Academy; or,
2. An application (new candidate intake form and certification packet) for the new hire was not
submitted to POST on this officer's behalf upon graduation and/or appointment to obtain certification.
Prather Guy 9999-5093 Winthrop Police Department
Donahue Sean 0332-8949 Winthrop Police Department
If the named officer(s) fall into Category 1 above, then please reply and confirm same. No further
action is required if the officer's name begins with I-Z, and the officer should be submitted for
recertification according to their last name. If the officer's last name begins with A-H, follow steps in
Category 2 as their statutory certification has expired.
If the named officer(s) fall into Category 2 above, then please submit the attached documents as soon
as possible, directly to me at the below email address as they are not presently certified by POST.
If you believe you have received this in error and any named officer has been certified, notify me at this
email address listed below.
Thank you for your attention to his matter.

To: Chief Terence Delehanty Tue 6/13/2023 5:57 PM
Dear Agency Head/POST Point of Contact:
As of the end of last week, it appears that your agency has not requested access to the new POST LEA portal. I’m
following up to remind you to apply for access and then log in to the portal at least once prior to actually submitting
your recertification applications to avoid any login issues. Remember, the last date to submit applications for
officers whose last name is I-P (and not previously certified or a new graduate) is June 30, 2023.
Copied below is the email from April 28 with instructions on how to apply for portal access.
If you have already applied for access and have not received your welcome email, please reach out to
postcsupport@mass.gov and we will help you resolve the issue. It does take a few days to verify and grant access,
so the faster you request it, the faster you will receive your credentials!
Also, as a reminder, we offer portal training on Tuesday and Thursday mornings at LOAM and Wednesday afternoon
at 2. You will find the link to training on our website at Recertification Overview |_Mass.gov.
If we can be of any help, please let us know at postcsupport@mass.gov.
April 28, 2023
In preparation for the launch of the new POST Commission LEA Portal on May 22, 2023, we are asking for your help
in providing a list of authorized portal users from your agency by May 12, 2023.
Every agency will be assigned a defined number of authorized portal users. This portal will be used not only for the
recertification process, but also for entering complaints received by your agency, disciplinary action taken and, in
the future, use of force reports. Authorized users also will be able to view complaints affecting your agency entered
directly through the POST Commission public complaint form. (https://policecomplaints.mass.gov/complaint ).
Each agency is allocated a designated number of licenses based on its size as shown below. If you feel that you
need more authorized portal users, please contact us and we will try to accommodate your request.

Enrique;
Thank you for your response. We have started to review the list of all active officers on POST website.
In order to complete the spreadsheet, | want to make sure that my retirees who become specials, who
only perform traffic control functions are not considered police officers under the definition put forth in
6E or the Commission's rules or regulations and therefore should not be listed as an active police officer
on the list | send back to you. Thanks again.

Chief Delahanty:
Yes, please add people who you know are active elsewhere, and were with your agency before, to the list of
individuals for whom you will submit summary disciplinary records (even if they were not in the list we provided —
we knew those lists would not capture all transfers).
For reference, please note that there is a list of all active officers in our website where you could also corroborate
the intelligence you have relative to individuals still active. That list is in pdf format, but you can search specific
names again to confirm whether those individuals are still active.
Thanks again.

Heads of Agencies:
Please note that in my prior e-mail this morning, | included a letter with instructions about submitting disciplinary
records of transferred officers. In that letter, the deadline for submitting those records is mentioned twice: In the
first instance it is correctly stipulated as January 31, 2022, and in the second instance it is incorrectly stipulated as
2021.
This is just to clarify that the deadline for submitting the records of transferred officers is indeed January 31, 2022.
Attached is a corrected version of that letter for your use.
Thanks for your attention to this.

Heads of Law Enforcement Agencies:
The following are additional instructions for the submission of summary
disciplinary information as required under the second sentence of Section
99 of Chapter 253 of the Acts of 2020.
We thank you for your earlier submission of the summary disciplinary
information for active officers employed by your agency. You will receive
an e-mail with an attachment that pertains to your agency. In that file,
you will see a list of individuals who, according to the Municipal Police
Training Committee’s records, were employed by your agency in the past
and are currently employed by a different law enforcement agency in the
Commonwealth. In the rest of this note, I will refer to the individuals on
those lists as “Transferred Officers.”
If you have not already submitted summary disciplinary information for
any Transferred Officer, please complete the template spreadsheet
entitled “Disciplinary Records Transferred Officers Submission
Template,” available on the POST Commission website at POST
Commission | Mass.gov. This template adds two additional fields to the
spreadsheet that you used to submit the summary disciplinary
information for active officers: “Employment End Date” and “Notes.” For
these purposes, “Employment End Date” refers to the end of the
individual’s employment with your agency. If you need to explain any of
your entries on this spreadsheet, please use the Notes field. If you have
no explanatory comments, you should leave the Notes field empty. When
submitting the records, please make sure to name the file “Disciplinary
Records of Transferred Officers - [Your Agency Name].”
As with your earlier submission, please submit this spreadsheet to the
POSTCReports e-mail box at POSTCReports@mass.gov. Please submit
this spreadsheet by January 31, 2022.

1. Ifthere are individuals on the list that we provide for whom your
agency does not have a record of employment or your agency has
only partial information, please include them on the spreadsheet,
and include any information available. Also include any
explanation in the Notes field (i.e., “no record of individual
assigned to this LEA,” “information is not available,” etc.).
2. Ifthere are individuals whose names are not on the list, who you
believe should have been included (for any reason), please review
the list of active law enforcement officers labeled “ All MA Active
Officers as of 12-08-21” (also on the POST website), and if you see
their names, please add those individuals’ names and summary
disciplinary information to the spreadsheet that you will be
providing, and include in the Notes field that the name was added.
3. Ifthere are individuals who may have resigned prior to a
disposition or disciplinary action to avoid discipline after April 1,
2021, please include the names of, and summary disciplinary
information for, those individuals on the spreadsheet that you will
be providing, regardless of those individuals’ current employment
as a law enforcement officer.
Re-submissions:
If you have already submitted summary disciplinary information for
Transferred Officers, please review the list we send you to ensure that
summary disciplinary information for all the individuals on the list was
included in your prior submission. If you have already submitted the
summary information for all Transferred Officers, it is not required that
you re-submit using the new template but you are welcome to do so. If you
choose to re-submit, please include the label “historical records re-
submission” in the e-mail subject line.
If there are any discrepancies (as described above) between the list that
we send you and your prior submission, please submit the corrected
information, using the new format, and include the label “historical
records re-submission” in the e-mail subject line.

Dear Mr. Hagemeister,
I have conducted a review of the documents and transmittals that have been
provided in the matter of your recertification in accordance with 555 CMR
7.10, a section of the POST Commission recertification regulations.
The following is a summary of the relevant correspondence.
1. Chief Terence Delehanty declined to attest to your good moral
character and fitness for employment as a law enforcement officer in
the recertification packet submitted by the Winthrop Police
Department to the POST Commission before June 15, 2022. Chief
Delehanty has provided a history of disciplinary related, as follow:
a) October 1989 Chief of Police David Rice (RET) - Citizen
complaint failed to act - Disposition Unknown.
b) January 1995 Chief Lamonica (RET) - Reassigned from
cruiser duty - Remedial training.
c) September 2009 Chief Delehanty - Improper uniform attire
verbal counseling by Lt. Scarpa (RET).
d) August 2010 Chief Delehanty - Improperly submitted
detail slip verbal warning by Lt. Scarpa (RET).
e) July 2013 Chief Delehanty - Failed to properly log call for
service verbal counseling by Lt. Lessard (RET).
f) April 2015 Chief Delehanty- Left detail assignment without

day suspension and one shift punishment duty, by Chief
Delehanty.
i) May 2017 Chief Delehanty - Violation of sexual
harassment policy sustained suspension 2 days and 3
punishment shifts by Chief Delehanty.
j) November 2017 Deputy Chief Goodwin- Failed to
PEACE OFFICER STANDARDS & TRAINING COMMISSION
properly document incident communicated to supervisor
Lt Lessard (RET) verbally counseled by Lt. Lessard.
k) May 2019 Deputy Chief Goodwin - Failed to properly log
call for service, failed to properly hire details and overtime
sustained re-assignment by Chief Delehanty.
2. In February of 2022, it was alleged that you failed to properly act upon
receiving a direct report of a violation of an emergency restraining
order.
3. On February 14, 2022, you were placed on paid administrative leave
and an investigation into alleged misconduct commenced.
4. On June 3, 2022, you resigned in lieu of termination and a settlement
agreement was reached between you, the Town of Winthrop, and the
Winthrop Police Union MCOP Local 421, AFL-CIO.
5. On August 23, 2022, you were issued a Notice of Denial of
Recertification by POST due to the following conditions:
a) Lack of completion of an oral interview/questionnaire
b) Lack of attestation by your agency.
6. On September 12, 2022, and February 10, 2023, you submitted to this
office a request for further consideration and an opportunity to be
heard on this matter.
Based on the information contained in the documents and correspondence listed above, I have
decided to issue a determination in your favor without a hearing.
555 Code of Massachusetts Regulations 7.05 describes the standards for “Determination of Good
Character and Fitness for Employment.” In particular, 555 CMR 7.05(A4) states, in part, that
“unless there have been allegations that an officer has engaged in multiple instances of similar
or related misconduct or protocols adopted by the commission provide otherwise, neither the
employing agency nor the division of certification shall consider an allegation of a particular
instance of misconduct [in rendering a determination regarding an officer’s good character and
fitness for employment] where... (c) [t]he officer has complied or is in the process of complying,
with any disciplinary action...in relation to the alleged misconduct, and the officer has not
engaged in any similar conduct since the discipline or decision.”
My findings are as follows:
Item la-k Historical Discipline
You have complied with the decisions issued at the time
Ttem 2 Failure to Act (Allegation)
You have complied with the decisions issued at the time resulting in resignation
Item 5a Oral Interview/Questionnaire
Yu oral interview was completed by Chief Delehanty
I find that you have complied with a disciplinary action imposed and taken full responsibility in
relation to the above matters. I further find that although you have multiple sustained charges
2
PEACE OFFICER STANDARDS & TRAINING COMMISSION
over your 33-year career as a Winthrop Police Officer, the incidents described do not constitute
multiple instances of similar or related misconduct, and protocols adopted by the Commission do
not provide for a different result. The Commission reserves the ability to revisit the matter of
your certification if it receives new information that paints a materially different picture of the
facts, in accordance with 555 CMR 7.09.
Therefore, L have instructed the Division of Certification to issue you a Full Certification.
Please note that you must remain in compliance with the requirements of Chapter 6E of the
Massachusetts General Laws and all regulations promulgated by the Commission for the
duration of your employment as a law enforcement officer.
Sincerely,
QI
