agreement established by an arbitration award covering an initial period of from
July 1, 2008 through June 30, 2011; and
WHEREAS, that agreement provided in Article XXXIX that the agreement
“shall remain in full force and effect until a succeeding agreement is
consummated;” and
WHEREAS, on October 22, 2010 the Supreme Judicial Court of
Massachusetts held in the case of Boston Housing Authority v. National
Conference Of Firemen and Oilers, Local 3, SJC-10569 that an “evergreen” clause
was no longer valid beyond three years;
NOW, THEREFORE, the parties agree to the following terms in order
normalize their relationship while they bargain for a successor to the July 1, 2008
— June 30, 2011 collective bargaining agreement.
1. Continuation of Contract. All the terms of the July 1, 2008 — June 30, 2011
collective bargaining agreement (including but not limited to Articles VIII
and IX, Grievance Procedure and Arbitration) shall be continued in full force
and effect for a base period of one year from October 13, 2011 through and
including October 12, 2012.
2. Continuation After Base Period. After the base period, this agreement will
continue in effect on a day-to-day basis terminable by either party on 60
days written notice to the other.
qi
. Obligation to Bargain. The parties commit themselves to bargaining a
successor to the July 1, 2008 — June 30, 2011 agreement effective
retroactive to July 1, 2011. The existence of this agreement shall not
relieve the parties of their obligation to bargain a successor to the July 1,
2008 — June 30, 2011 agreement effective retroactive to July 1, 2011, nor
shall it preclude the parties from utilizing any of the impasse resolution
procedures available, including mediation, factfinding, and interest
arbitration to settle the terms of that agreement.
. Legislation. The parties are aware of legislation being introduced which
might nullify the effect of the Boston Housing Authority case and might
restore the effectiveness of the evergreen clause in the July 1, 2008 —June
30, 2011 contract. If such legislation should be enacted, then the
evergreen clause in the July 1, 2008 — June 30, 2011 contract shall replace
this agreement from the date on which that evergreen clause again
becomes effective.
. Settlement of Litigation. The Union shall request the withdrawal of its
charge of prohibited practice and the cancellation of the November 2, 2011
hearing in the matter at the Department of Labor Relations entitled iBPO,
Local 397 and Town of Winthrop, MUP-11-6275.
