Action steps: Legal Notice will be posted in the Winthrop Transcript next week (2/20/2020). Document reviewed: revised regulation drafted by Chair Schmidt. TOBACCO: Per Bonny Carroll, Massachusetts Attorney General Maura Healey has filed a lawsuit against Juul for allegedly targeting youth by advertising their vape products on both Nickelodeon and Cartoon Network, two networks whose main audience is youth. On June 1, 2020 sale of all flavored products, including menthol products will be prohibited. Also, retailers must take down any advertising for products they can’t sell. The new law states that any retailer who is not an adult only tobacco store can only sell vape products that are less than 35 mg per milliliter or 3% nicotine. And, in order to legally sell them, they must show to the inspector (Bonny Carroll) a letter from the manufacturer(s) of whatever product(s) they are selling confirming that their product(s) contain under that amount. To that end, Juul has issued a letter to retailers stating that they can’t give retailers such a letter because even though their product label says 3% nicotine, they cannot guarantee that that is true. They state that their 3% nicotine product could range from 2.8% -3.2% nicotine. So, in effect, no Juul product can be sold right now in regular retail stores. Age 21 adult only tobacco stores are not required to have these types of letters and are allowed to sell any amount of nicotine in their products.
