Has there been any decision made? Has a legal opinion been received yet regarding the interpretation of the Town Charter as it pertains to appointment of a chair? Also, | see that on tonight's TC agenda there is a Committee Handbook under Old Business. Has the proposed Committee Handbook been distributed to the various Boards for comment? (I have not received it.) ! would welcome an opportunity to review the proposed Committee Handbook prior to tonight’s meeting. Even without having the opportunity to see the contents of the proposed language, | am concerned that the document will serve as an amendment or revision to the Town Charter, which would require adherence to the Article LXXXIX of the Commonwealth’s Constitution. https://www.mma.org/wp-content/uploads/2018/07/articleg9 O.pdf That being said, | do not believe that the Town Council can proceed procedurally without first publishing the proposed Committee Handbook. Further, given that the proposed change likely relates to the ‘composition, mode of election or appointment, or terms of the legislative body’, the procedure for revision would be required to follow Article 2, §3 (A petition signed by 15% of the registered voters...), rather than simply a 2/3" vote of the council. ! look forward to hearing from you. -Marc Marc E.
