Public hearing continued: swimming pool regulations: opened
6:38 pm.

Rose Demarco, a trustee of Seal Harbor One, is recognized. Ms
Demarco questions the use of Chelsea as a model for pool
regulations in Winthrop. She further states that the imposition of a
mandated lifeguard at Seal Harbor One would be an undue financial
burden on the residents of Seal Harbor One. Ms Demarco comments
that mandated lifeguards at Yirrell Beach would be more
appropriate. Bill clarifies that the Town Council has authority over
beach lifeguards, the Board of Health does not have the ability to
regulate this. Bill also states the rationale for adapting the
regulations in Chelsea for Winthrop was because Al Legee,
Commissioner of Inspectional Services had previously worked in

the management company by IS may be passed on to the renters of
the building. She also asks if barrels could be used to supplement
the dumpster, even temporarily, until a more permanent solution can
be found. Bill states that the hauler is not likely to pick up extra
barrels, as dumpsters are permitted by the Board, and barrel pickup
would be under the hauler’s discretion. Justin Kopec, proprietor of
JustInk Tattoos, is recognized. Mr Kopec points out that there are
around a dozen small businesses that use that one dumpster. He
states that he is often picking up the overflow of trash next to the
dumpster, because of the volume and need for more frequent
pickup. Currently pickup is once a week on Mondays. He states that
it is unsightly and unsanitary, and that frequent requests for a
remedy to the managers of the building he is renting space from
have not been heeded. Bill states that there are limits to what the
Board can do, other than issue citations/suspend permits. Bill states
that he will investigate what citations have been issued, and then
draw up a letter to the hauler and/or the property manager. Mr
Kopec states he would like to contact the hauler himself to see what
could be done. Bill states that if Mr Kopec could email the Board
with any updates prior to the next meeting in September, it would be
very helpful.

833 Shirley St: Al’s email states that the violations have been
resolved.

97 Court Road: Al’s email states that contractor has been hired,
case will be closed shortly.

435 Shirley Street: Al’s email states that IS has been in touch with
the building maintenance co and that repairs will be completed soon.

Beach water testing and closures: Al’s email states that testing
occurs weekly until Labor Day. No closings in the past few weeks.

Virtual restaurants: no further updates

Mosquitoes and ticks: Marianne reports that spraying at Belle Isle
Cemetery was done by NEMMC on the evening of August 3.

Bill reports that the period for comments about airport runway
extension has been extended by Massport, until August 22.

Proposed agenda for September meeting: proposed change in
meeting day next month to 9/13/22, all in agreement.

Adjournment: 7:47 pm, approved unanimously 3-0.

Respectfully submitted,

Marianne Dalton, Member
