Discuss/vote former Officer Robert Hurley’s Section 3(5) regarding reserve police service Section 4(2)(b) for the period October 5, 1995 — March 31, 1996. Attorney Sacco reviewed the Gomes decision as it applies to Section 4(2)(b) how it should be interpreted and applies to reserve officers and stated Winthrop has had its fair share of issues with some officers having payroll records and others who have no records receiving the service for free. Attorney Sacco stated the first course of action would be for Mr. Hurley to contact the Boston Retirement Board and request purchase of service since he did not purchase reserve time while in Winthrop. Attorney Sacco recommended that WRB accept liability and have Mr. Hurley direct his request to Boston Retirement Board under Section 3 (5) regarding rendering service in another system. He believes if Winthrop denies the liability the Board would likely lose at DALA then be challenged. He believes that this would set precedence that we would have to grant others the time as well. He feels that there is no need for a Board vote currently and to wait for Boston to send a letter requesting 3(8)(c) liability.
