5:33 - Call to Order
Public Comment:
EK: Representing Edgetts; property has been in the family since the 1960s, Gina & Bill took
ownership in 2020. 5’ of 10’ strip of land belongs to Edgetts, the other 5’ belongs to 70 Summit
(C.Scott). No lights, poor/dangerous conditions, have had to call police for loitering/drug use;
Want to turn part of space into driveway between houses (would require removal of a tree)
Gina Edgett (60 Summit): have supplied town will all requested docs/scope of work/plans/etc.;
street has seen increase in number of condos, etc. resulting in increased number of cars
MT: What do neighbors on Sagamore think?
EK: have not had correspondence with them
MT: Cannot release right of way for HALF of a pathway; would need to do full path (Summit to
Sagamore)
SC: Concerned about cutting path in half and creating ‘alcove’; could exacerbate loitering, etc.
MT: What is the town responsible for in regards to the state of the property if returned?
SC: Would have to check with Town Attorney, but likely need to restore to ‘original condition’
SS: What would it cost to restore pathway to safe/compliant status?
SC: would need to go to bid, so difficult to say. Half of path alone would be >$50K
MT: What would ongoing cost of maintenance be?
SC: to restore fully Summit to Sagamore, approx. $120-$150K (stair removal, rapport stairs,
railings, lights, etc.); need to determine if land needs to be restored before it is given back
EK: Client will incur cost of restoration for their portion of the right of way

Charlie Scott (70 Summit): lived there since 1951; town has not unkept walkway in past 20-30
years; installed motion sensor lights; disagree with Calla about concerns of creating ‘alcove’;
stairs are incredibly unsafe and town is liable for disrepair and long term maintenance
SC: Entirety of walkway needs restoration
SS: Need to identify estimate for restoration and source of funds
Barbara Flockhart (P4): Do not need to include pathway from Hutchinson to Crest in this
renovation
MT: Would need to restore FULL pathway that town is responsible for
HB: Two separate issues - this Summit Ave. path, and how to handle these public ways as a
whole
SS: Will need to talk to town attorney to see how to handle disposition of rights of way
SC: Reminder that even if right of way is dissolved, permits and/or a variance will still need to be
applied for to create the intended driveway between properties
*Please see attached spreadsheet regarding the public ways in town and their status*
6:32 - motion to adjourn by MT, 2nd by SS, unanimously approved
