ADJOURNMENT TOWN OF WINTHROP OFFICE OF THE TOWN COUNCIL Town Hall, 1 Metcalf Square, Winthrop, MA 02152 Telephone: 617-846-1742 TOWN COUNCIL MOTION Submitted By: Councilor Aiello Date: June 24, 2025 General Background: The Commonwealth of Massachusetts has astutely continued to enact and update guidelines that amend Open Meeting Law to allow for remote participation in meetings by both the public and members of the body holding the meeting, such as the Town Council. This flexibility allows situations that may preclude physical attendance at a meeting such as illness, professional obligations, travel, etc. to have no negative impact on attendance for Town Council members. The availability of remote participation also enables greater participation by the public. TEXT OF MOTION I move to amend the Winthrop Town Council Rules and Procedures to include a rule that indicates that all special and regularly scheduled meetings of the Town Council shall be held in the Harvey Hearing Room, or another such venue fully equipped with video conferencing technology that would enable a member of the Town Council to participate remotely in accordance with Chapter 2 of the Acts of 2025 and any subsequent updates to Section 20 of Chapter of the Acts of 2021 unless there is a majority vote of the council to select a different venue. TOWN OF WINTHROP OFFICE OF THE TOWN COUNCIL Town Hail, 1 Metcalf Square, Winthrop, MA 02152 Telephone: 617-846-1742 TOWN COUNCIL MOTION Submitted By: Councilor Aiello Date: June 24, 2025 General Background: The Winthrop Town Charter sets forth an abandonment clause without defining in detail what constitutes attendance at a meeting. To avoid any misapplication of this clause by the current or any future councils, this ambiguity should be resolved. TEXT OF MOTION I move that the Town Council respectfully request that the Town Manager, in consultation with the Town Attorney, conduct a comprehensive review of all applicable provisions within the Winthrop Town Charter, Town Council Rules, municipal ordinances, relevant statutes of the Commonwealth, and any pertinent administrative regulations in order to identify and clarify the legal standards that determine whether a Councilor is deemed to have officially attended a meeting of the Council—whether such attendance is in person or via remote participation. The Council further requests that a written report be submitted outlining the findings of this review, along with any recommendations for action or amendment, to ensure alignment with current legal and procedural requirements.
