RE: MUP-15-4652 Winthrop, Town of and Ferruccio Romeo
Dear Ferruccio Romeo and Howard Greenspan, Esq.:
The Department of Labor Relations (Department) has received, docketed and reviewed
the above-referenced charge. The review indicates that the Union filed a grievance(s) related
to the allegations in the charge and that the allegations contained in the charge are essentially
questions of contract interpretation. Thus, prior to conducting an investigation, the Department
directs the parties to state their respective positions on whether the Department should defer
the case to arbitration. See Cohasset School Committee, MUP-419 (1973) and Section 11 of
Massachusetts General Laws, Chapter 150E, as amended by Chapter 145 of the Acts of 2007.
The parties’ written responses are due in the Department's Boston office within thirty (30)
days of receipt of this notice and must address the following:
1. Whether the grievance(s) was/were filed prior to the expiration of the collective bargaining
agreement;
2. Whether the grievance remains pending; and
3. Any other issues pertinent to the deferral determination.
IF THE CHARGING PARTY FAILS TO RESPOND TO THIS REQUEST WITHIN THIRTY (30)
DAYS OF THE DATE OF THIS NOTICE, THE DIVISION WILL DISMISS THE CHARGE
WITH PREJUDICE AND WITHOUT FURTHER NOTICE. IF THE RESPONDENT FAILS TO
RESPOND TO THIS REQUEST, THE DEPARTMENT WILL MAKE A DEFERRAL
DETERMINATION WITHOUT THE RESPONDENT’S RESPONSE.
If you have any questions, please do not hesitate to contact me.
Very truly yours,
DEPARTMENT OF LABOR RELATIONS
